HC relieves DHSK from personal appearance

Srinagar, Sept 25: High Court after clarifying the implementation of judgment relieved the Director Health Services Kashmir (DHSK) from personal appearance and directed for personal appearance of Treasury Officer (TO) and Block Medical Officer (BMO) to explain the non-implementation of judgment.
“…before proceeding against the Treasury Officer, Sumbal, he shall appear in person before the court on next date with an explanation as to how he has disowned the salary bills of the petitioners over an issue that is settled by this court in terms of the judgment dated 19th March, 2020”, Justice Ali Mohammad Magrey directed.
Court however made it clear that if the salary bills of the petitioners are honoured and payment is released in their favour before the next date, then the Treasury Officer, Sumbal, need not to appear before the court.
“On the next date before the Bench, only the Block Medical Officer, Hajin and the Treasury Officer, Sumbal, shall appear before the Court. The personal appearance of the Director, Health Services, Kashmir and the Chief Medical Officer, Bandipora, is dispensed with till further orders”, Court added.
It was in compliance of direction of the court, the Director, Health Services, Kashmir Dr Mushtaq Ahmad,was present along with Dr Bashir Ahmad Khan, Chief Medical Officer, Bandipora and Dr Ajaz Ahmad Kanth, Block Medical Officer, Hajin before the court and submitted that the department has already implemented the judgment and final order of this Court by submitting the salary bills of the petitioners before the Treasury Officer of Government Treasury, Sumbal.
The DHSK further submitted that these bills are prepared by the Block Medical Officer, Hajin who is the drawing and disbursing officer of the petitioners. Dr Ajaz Ahmad, BMO Hajin submitted that the bills have been submitted on September 16, 2021, but the Treasury Officer, Sumbal, did not own it for the reason that the GP Fund numbers of the petitioners are deactivated.
